Terms of Service

Effective Date: August 1, 2025

These Terms of Service ("Terms") govern your use of the Work Counter mobile application (the "App") provided by Beren Software ("we," "our," or "us"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.

1. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement and have the legal capacity to enter into this agreement.

2. License

We grant you a personal, non-exclusive, non-transferable, limited license to use the App solely for your own work hour tracking and project management purposes.

You may not copy, modify, distribute, sell, or lease any part of the App.
Reverse engineering or attempting to extract the source code is prohibited unless explicitly permitted by law.

3. Account and Data Storage

The App does not require creating an account.

All your hour entries, projects, and notes are stored locally on your device and optionally synchronized via your personal iCloud account.
We do not have access to or control over this data.

4. Purchases and Subscriptions

The App may offer in-app purchases or subscriptions managed through Apple's App Store and facilitated by RevenueCat.

By making a purchase, you agree to Apple's payment terms.
Prices and subscription terms may change; changes will be communicated within the App or via the App Store.

5. Acceptable Use

You agree not to:

Use the App for any unlawful or unauthorized purpose.
Attempt to interfere with or disrupt the integrity or security of the App.
Use the App in a way that could damage, disable, overburden, or impair its functionality.

6. Intellectual Property

All rights, title, and interest in and to the App (excluding your locally stored data) remain with Beren Software.

You are not granted any rights to trademarks, logos, or other brand elements.
Unauthorized use of our intellectual property is strictly prohibited.

7. Third-Party Services

The App integrates third-party services:

RevenueCat for subscription management.
TelemetryDeck.

Your use of these services is also subject to their respective terms and policies.

8. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

Fitness for a particular purpose
Accuracy of information
Uninterrupted or error-free operation

We do not warrant that the App will meet your requirements or be free from security vulnerabilities.

9. Limitation of Liability

To the maximum extent permitted by law:

Beren Software and its affiliates shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the App.
Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the App or related in-app purchases during the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Beren Software and its affiliates from any claims, damages, liabilities, costs, or expenses resulting from:

Your violation of these Terms
Your misuse of the App
Your infringement of any third-party rights

11. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

12. Changes to the Terms

We may update these Terms periodically. Updates will be posted in the App or on our website, with the "Effective Date" revised accordingly. Continued use of the App after updates constitutes your acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively by the competent courts located in the Netherlands.
